Guardia say German had been arrested on child pornography charges.
A row broke out at a restaurant in San Roque (Cádiz) when a man, now named as British national Kainth Devinder, spotted German Sandro Rottman filming his daughter on a tablet.
Rottman continued to film despite warnings, and paid with his life when Devinder allegedly struck the German on the head. He later died after being admitted to hospital.
Guardia Civil said that Rottman “had been arrested a few days earlier for being in possession of child pornography”.
The confrontation occurred at Spinnaker restaurant in the upmarket Sotogrande port residential development.
An ambulance was called by security staff and took Rottman to hospital, where he later died.
It is understood the alleged attacker had returned home, and was arrested there on the testimony of witnesses at the restaurant.
